This website is operated by Homeview Furniture. Throughout the site, the terms “we”, “us” and “our” refer to Homeview Furniture. Homeview Furniture offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse Service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.
SECTION 3 - PRODUCTS, SERVICES AND LEAD TIMES
Certain products or Services may be available exclusively online. These products are subject to return or exchange only according to our Refund Policy.
- Lead Times: While we strive for precision, lead times vary by brand. In-stock orders typically depart the warehouse within 3-5 business days after payment capture. These are estimates and not guarantees.
- Product Representation: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your monitor's display will be accurate.
SECTION 4 - ACCURACY OF BILLING, STOCK VERIFICATION & MERCHANT FEES
- Payment Capture Policy: Upon order placement, your payment method is pre-authorized. We immediately verify stock with our suppliers. Payment is only captured once fulfillment is confirmed. If unavailable, the pre-authorization is voided.
- Non-Refundable Fees: Credit card processing fees (typically 2.9% to 5.99% + $0.30) are non-refundable by financial institutions. These fees will be deducted from any eligible refunds issued.
- Order Limitations: We reserve the right to refuse any order. We may limit or cancel quantities purchased per person, per household or per order at our sole discretion.
SECTION 5 - SHIPPING, FREIGHT AND DELIVERY OBLIGATIONS
- Geographic Restrictions: We ship exclusively to the 48 contiguous United States. No shipping is provided to Alaska, Hawaii, or International destinations.
- Shipping Options: Free shipping applies to orders over $199.00. Orders under $199.00 incur a flat $19.95 fee. Liftgate services for freight orders incur an additional specialized fee.
- Curbside Freight: Large items are delivered curbside only. Drivers are not authorized to enter the residence. Failure to attend a scheduled appointment will result in a 50% re-delivery fee.
- Damage Inspection: You must note any exterior damage on the delivery receipt at the time of signing. All damages must be reported with photos/videos within 24 hours of arrival to support@homeviewfurniture.com.
- Stolen Packages: We are not liable for packages marked "delivered" by carriers. Claims must be filed directly with FedEx or UPS.
SECTION 6 - PROHIBITED USES & CHARGEBACKS
In addition to standard prohibitions, customers are strictly prohibited from filing chargebacks due to shipping delays. Cancellations resulting from shipping delays remain subject to all associated shipping, merchant, and storage fees. Fraudulent chargebacks may result in criminal liability for theft.
SECTION 7 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee that your use of our Service will be uninterrupted or error-free. In no case shall Homeview Furniture, our directors, or affiliates be liable for any injury, loss, or consequential damages of any kind, including lost profits or revenue, arising from your use of the Service or shipping delays beyond our control.
SECTION 8 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes will be resolved exclusively in the courts of El Paso, Texas.
